Terms and Conditions

1. General provisions:
1.1 The operator of the e-shop is Michal Macko – BPS, address Tulská 5, 960 01 Zvolen, registered in the Trade Register under number: 620-23256, ID number: 41969626, VAT number: 1073817261, tel. +421917293733, e-mail: info (at) makemehappy.sk (hereinafter referred to as the "Seller"). 1.2 The Customer is the entity that has ordered the delivery of plugins from the Operator (hereinafter referred to as the "Customer").
1.3 These Terms and Conditions are an integral part of the contract concluded between the Operator and the Customer in connection with the delivery of plugins by the Operator to the Customer.
1.4 The Customer declares that prior to placing an order pursuant to Article III of these Terms and Conditions, they have read and fully agree with the contents of the Terms and Conditions.

2. Registration
2.1 On the website https://makemehappy.sk, the Customer can purchase plugins from the Operator even without registration. The Customer can also register during the ordering process.
2.2 By registering, the Customer gains access to the My Account section, where they can view an overview of their orders or subscriptions, and find links to download the latest versions of plugins for which they have a subscription.
2.3 The Customer undertakes to provide only accurate and truthful information during the registration process.

3. Order process
3.1 To place an order, the Customer selects the desired service and clicks on the Buy button.
3.2 After sending the order, the Customer will receive a confirmation of receipt of the order at the email address provided during the order and/or registration. At the same time, their order will be displayed in the My Account section, which you can access after logging in.
3.3 Upon delivery of the confirmation of receipt of the order, the Customer concluded a contract with the Operator.

4. Payment methods
4.1 Payment must be made by the Customer as follows:
– via the GoPay payment gateway (with this payment, the customer will receive the license details immediately after the payment has been made)
– via the Stripe payment gateway (with this payment, the customer will receive the license details immediately after the payment has been made)
– by transfer to account (with this option, the customer will receive the license details within 24 hours of the money being credited to the operator's account)

5. Delivery method
5.1 After the payment has been successfully credited to the Operator's account, the customer will receive an email with a link to download the plugin and a link to download the invoice. If the Customer does not receive any email within 30 minutes after payment, they are required to contact the Operator's technical support by email at info (at) makemehappy.sk.

6. License
6.1 All our plugins are licensed under the GNU General Public License (GPL). You can read an informative Slovak translation of the GPL.

7. Updates
7.1 By submitting and paying for the order, the Customer automatically gains access to updates and technical support for the plugin for a period of one year for one website specified in the plugin order.
7.2 Updates and technical support for the plugin for subsequent periods can be ordered by adding the plugin to your cart and clicking on Renew Existing License.
7.3 The Operator does not guarantee compatibility with older versions of systems.

8. Technical Support
8.1 Technical support is provided by the Operator to customers who have an active subscription to the plugin to which the support relates.
8.2 Technical support is provided by the Operator via email at info (at) makemehappy.sk.

9. Withdrawal from the warranty
9.1 Each of our plugins is PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIMS, DAMAGES OR OTHER LIABILITY, WHETHER IN CONTRACT, TORT OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, THE SOFTWARE OR THE USE OR OTHER DEALING IN THE SOFTWARE.
9.2 The Operator shall not be liable for any damage, in particular direct, indirect, special, incidental or consequential damage, or other losses associated with the use, caused by the use, or resulting from the inability to use our plugin, e.g. due to the Customer's outdated system.

10. Money-back guarantee
10.1 If the Customer does not use the Operator's services and plugins for any reason, they may request a refund from the Operator within 30 days of paying for the order.
10.2 In the event of a request by the Customer pursuant to the previous article, the Operator shall refund the amount paid to the Customer's account or by other means as agreed with the Operator.
10.3 The request must be sent from the email address provided in the order, and the Customer is required to verify their identity in accordance with the Operator's requirements and instructions.

11. Protection of personal data
11.1 The Customer agrees, pursuant to Section 13(1)(a) of Act No. 18/2018 Coll. on the protection of personal data, as amended, to the processing of the Customer's personal data by the Operator.
11.2 The Operator is entitled to process personal data only to the extent necessary to fulfill the terms of the contract and in connection with the contract.

12. Final provisions
12.1 These Terms and Conditions shall be interpreted in accordance with the generally binding legal regulations of the Slovak Republic (SR), in particular Act No. 40/1964 Coll. Civil Code, as amended, and Act No. 513/1991 Coll. Commercial Code, as amended, and other relevant legal regulations.
12.2 Any legal disputes related to these Terms and Conditions shall fall under the exclusive jurisdiction of the courts of the Slovak Republic and shall be governed by the relevant laws of the Slovak Republic, even if the Customer is not a citizen of the Slovak Republic or does not have its registered office in the Slovak Republic, or if it is a person established under the laws of another country.
12.3 The Operator has the right to change these Terms and Conditions without prior notice to the Customer. The current version of the Terms and Conditions will always be published on the website https://makemehappy.sk/obchodne-podmienky/.

These Terms and Conditions shall become valid and effective on December 1, 2025.
