1. General Provisions
1.1 The operator of the online store is Michal Macko – BPS, located at Tulská 5, 960 01 Zvolen, registered in the Trade Register under number: 620-23256, Company ID: 41969626, Tax ID: 1073817261, tel. +421917293733, email: info (at) makemehappy.sk (hereinafter referred to as the „Operator“ or „Seller“).
1.2 The Customer is a natural person or legal entity that has ordered the delivery of software—WordPress plugins—from the Operator (hereinafter referred to as the „Customer“).
1.3 These Terms and Conditions are an integral part of the contract for the provision of digital content entered into between the Operator and the Customer.
1.4 Legal relationships between the Operator and the Customer, who is a consumer, are governed by the Civil Code and Act No. 108/2024 Z. z. on Consumer Protection. Legal relationships with a Customer who is a business are governed by the Commercial Code.

2. Registration and User Account
2.1 On the website https://makemehappy.sk The Customer may purchase plugins with or without registration. Registration can also be completed during the ordering process.
2.2 By registering, the Customer gains access to the "My Account" section, which contains an overview of orders and subscriptions, as well as links to download the latest versions of plugins for which the Customer has an active update license.
2.3 The Customer agrees to provide only accurate and complete information during registration and when placing an order.

3. Order Process and Contract Formation
3.1 To place an order, the Customer selects the desired plugin, fills in the billing information, and clicks the button confirming the order and the obligation to pay.
3.2 After submitting the order, the Customer will receive an order confirmation at their email address. At the same time, the order will be displayed in the "My Account" section.
3.3 The contract is concluded upon delivery of the order confirmation and subsequent payment of the price.

4. Payment methods
4.1 The Customer must pay for the digital content using one of the following methods: – via the GoPay payment gateway (the Customer will typically receive the license information and a download link immediately after the payment is successfully processed), – by bank transfer to the Operator’s account (the Customer will receive the license information within 24 hours of the funds being credited to the Operator’s account).

5. Method of Delivery of Digital Content
5.1 Once the payment has been successfully processed, the Customer will receive an email containing a link to download the plugin installation file and a link to download the invoice.
5.2 If the Customer does not receive an email with a link within 30 minutes of verifiable payment (for card payments), they must contact support at info (at) makemehappy.sk.

6. License
6.1 All of our plugins are licensed under the GNU General Public License (GPL). The customer is entitled to review the text of this license before making a purchase.

7. Updates and Technical Support
7.1 Upon payment for the order, the Customer gains access to updates and technical support for the plugin for a period of one year (12 months) from the date of purchase.
7.2 The Customer may extend access to updates and support for a subsequent period by purchasing the license again.
7.3 The Operator provides technical support exclusively to customers with an active subscription, via email.
7.4 The Operator does not guarantee the backward compatibility of plugins with obsolete and unsupported versions of the WordPress content management system or older versions of PHP.

8. Contract Cancellation and Money-Back Guarantee (14 days)
8.1 The Operator provides the Customer (whether a consumer or a business) with a money-back guarantee. The Customer has the right to cancel the contract and request a refund of the amount paid without providing a reason within 14 calendar days from the date of purchase of the plugin.
8.2 A refund request must be sent to the email address info (at) makemehappy.sk from the email address used to place the order.
8.3 Consequences of a refund: Once the request has been approved and the funds have been refunded, the license key associated with that order will be immediately deactivated. The customer thereby permanently loses access to future updates of the plugin and any entitlement to technical support from the Operator for that product.

9. Liability for Defects and Withdrawal from the Warranty
9.1 With respect to Customers who are business entities, the software is provided „as is,“ without any warranty. In a B2B relationship, the Operator is not liable for any direct or indirect damages associated with the use of the plugin.
9.2 With respect to Customers who are consumers, the Operator is responsible for ensuring that the digital content is free from defects and possesses the characteristics specified in the product description. The consumer’s statutory rights to report a defect (file a complaint) remain unaffected.

10. Protection of Personal Data
10.1 The Operator processes the Customer’s personal data in accordance with the GDPR and Act No. 18/2018 Coll. on the Protection of Personal Data.
10.2 The legal basis for the processing of personal data is performance of the contract (Article 6(1)(b) of the GDPR).

11. Alternative Dispute Resolution and the Supervisory Authority
11.1 The consumer has the right to file a request for alternative dispute resolution (ADR) with an entity pursuant to Act No. 391/2015 Z. z., or to use the ODR platform to http://ec.europa.eu/consumers/odr/.
11.2 The supervisory authority is the SOI Inspectorate for the Banská Bystrica Region, Kupeckého 71/A, 974 01 Banská Bystrica 1.

12. Final provisions
12.1 These Terms and Conditions are governed by the laws of the Slovak Republic. Any legal disputes fall under the jurisdiction of the courts of the Slovak Republic.
12.2 The Operator reserves the right to change these terms and conditions. The terms and conditions in effect at the time the order is placed shall apply.

These Terms and Conditions shall take effect on June 20, 2026.

3.2 Upon placing an order, the Customer receives an order confirmation via email.
3.3 The contract is deemed to be concluded upon delivery of the order confirmation and payment of the purchase price.

4. Payment Methods
4.1 The Customer must pay for the digital content via: – the GoPay payment gateway (immediate delivery of license details), – bank transfer to the Seller’s account (delivery of license details within 24 hours of the funds being credited).

5. Delivery of Digital Content
5.1 Once payment is credited, the Customer will receive an email containing download links for the plugin and the invoice.
5.2 If the email is not received within 30 minutes of a confirmed card payment, the Customer is required to contact support at info (at) makemehappy.sk.

6. License
6.1 All of our plugins are licensed under the GNU General Public License (GPL).

7. Updates and Technical Support
7.1 The Customer gains access to updates and technical support for the plugin for a period of one year (12 months) from the date of purchase.
7.2 Access can be extended by repurchasing the license.
7.3 Support is provided exclusively via email to customers with an active subscription.
7.4 The Seller does not guarantee backward compatibility with outdated versions of WordPress or PHP.

8. Right of Withdrawal and 14-Day Money-Back Guarantee
8.1 The Seller offers the Customer (whether a consumer or a business) a money-back guarantee. The Customer has the right to cancel the contract and request a full refund without giving any reason within 14 calendar days from the date of purchase.
8.2 The refund request must be sent to info (at) makemehappy.sk from the email address used during checkout.
8.3 Consequences of a refund: Once the refund is processed, the license key associated with the order will be deactivated immediately. As a result, the Customer will permanently lose access to future plugin updates and forfeit any right to technical support from the Seller for that product.

9. Liability for Defects and Disclaimer of Warranties
9.1 For B2B Customers, the software is provided "AS IS," without warranty of any kind. The Seller shall not be liable for any direct or indirect damages.
9.2 For B2C Customers (consumers), the Seller is liable for ensuring that the digital content is free of defects. Statutory consumer rights remain unaffected.

10. Data Protection
10.1 The Seller processes personal data in accordance with the GDPR and Slovak Act No. 18/2018 Coll.
10.2 The legal basis for data processing is the performance of a contract (Article 6(1)(b) of the GDPR).

11. Alternative Dispute Resolution and the Supervisory Authority
11.1 The consumer may use the ADR entity established under Act No. 391/2015 Coll. or the ODR platform at http://ec.europa.eu/consumers/odr/.
11.2 The supervisory authority is the Inspectorate of the Slovak Trade Inspection (SOI) for the Banská Bystrica Region, Kupeckého 71/A, 974 01 Banská Bystrica 1.

12. Final Provisions
12.1 These Terms are governed by the laws of the Slovak Republic. Disputes fall under the jurisdiction of Slovak courts.
12.2 The Seller reserves the right to amend these Terms. The applicable terms are those in effect at the time the order was placed.

These Terms and Conditions shall take effect on June 20, 2026.
